ARTICLE 1: PURPOSE The general conditions of sale described below detail the rights and obligations of the company OMAR SAMASSA and its customers in connection with the sale of the following goods: Clothing and accessories. Any service performed by the company OMAR SAMASSA implies the unreserved acceptance of the buyer to these terms and conditions of sale. ARTICLE 2: PRESENTATION OF THE PRODUCTS The characteristics of the products offered for sale are presented in the "Catalog" section of our website. The photographs do not enter the contractual field. The responsibility of the company OMAR SAMASSA can not be engaged if errors were introduced there. All the texts and images presented on OMAR SAMASSA's website are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly forbidden. ARTICLE 3: DURATION OF VALIDITY OF OFFERS OF SALE The products are offered for sale until the stock is exhausted. In case of order of a product become unavailable, the customer will be informed of this unavailability, as soon as possible, by email or by post. ARTICLE 4: PRICES OF PRODUCTS The heading "Catalog" of our site indicates the prices in euros all taxes included, except shipping costs. The amount of VAT is specified when selecting a product by the customer and shipping costs appear on the screen at the end of the selection of different products by the customer. The company OMAR SAMASSA reserves the right to modify its prices at any time but the products ordered are invoiced at the price in force at the time of the registration of the order. OMAR SAMASSA confirms the order by e-mail; this information includes all the elements of the order and the right of withdrawal of the customer. It is archived by the company OMAR SAMASSA under the conditions and legal deadlines; the customer can access this archive by contacting the Customer Relations Department. ARTICLE 6 TERMS OF PAYMENT The payment of orders is made by credit card. When registering the order, the buyer must pay the entire order for the receipt of goods. ARTICLE 7: WITHDRAWAL PERIOD The Purchaser has a period of fourteen clear days, from the date of receipt of the products, to exercise his right of retraction without having to justify reasons or to pay penalties, except, where applicable, return fees. If the fourteen day period expires on a Saturday, Sunday or a holiday or holiday, it is extended until the next business day. In case of exercise of the right of withdrawal, the company shall reimburse the Buyer for all amounts paid, as soon as possible and at the latest within fourteen days from the date on which this right was exercised. ARTICLE 8: DELAY IN PAYMENT (CLAUSE APPLICABLE TO PROFESSIONALS) In the event of total or partial failure to pay the goods delivered on the day of receipt, the buyer must pay the company OMAR SAMASSA a late penalty equal to one time and half the rate of legal interest. The legal interest rate used is that in force on the day of delivery of the goods. This penalty is calculated on the amount before taxes of the sum remaining due, and runs from the date of expiry of the price without any prior notice being required. In accordance with articles 441-6 c. com. and D. 441-5 c. com., any late payment entails, in addition to late penalties, an obligation for the debtor to pay a fixed compensation of 40 € for recovery costs. Supplementary compensation may be claimed, on receipts, when the recovery costs incurred exceed the amount of the lump sum compensation. ARTICLE 9: DELIVERY Any product is delivered without guarantee as to the deadlines, except for the deliveries to the private individuals. The delivery deadline varies according to their address. It is fixed for an address in mainland France, the day of payment + 8 days and, for other destinations, the day of payment + 1 month.
